CONDITIONS OF SALE:

Checks, Money Orders, Bank Transfers, Visa, MasterCard, Discover, and American Express. We

do not accept checks on C.O.D. orders. All orders shipped C.O.D are to be paid by Money

Order or Cashier’s Check. All checks mailed in will be sent for direct collection prior to order

being shipped.

UPS charges $8.50 per package on C.O.D. orders. You can avoid this charge by placing your order

on a credit card. We do not ship orders C.O.D. by freight line truck. Do not Include an amount for

shipping; if shipped by truck. Freight charges will be collected upon delivery. Prices and discounts

are subject to change without notice. Orders accepted with the understanding that price and discounts prevailing at the time of shipment shall apply.

NOTIFICATION OF LOSS/SHORTAGE:

You have 15 days from your Date Of Delivery to check your Goods and list any damaged or missing

Items. These Items should be listed, by Inventory Number and Name. The Claim should be sent to our Office for processing. Failure to deliver this information within 15 days, or to list all Items, will result in

a less amount payable on your Claim, or may result in the loss of your entire Claim. Annotation of Loss

or Damage on the Carrier's Inventory or any other Form is not acceptable for processing a Claim.

The Claim may be faxed or phoned in to our Office.

Day, or Next Day orders C.O.D.

Upon authorization, returns must be shipped freight prepaid and may be subject to a restocking

charge, normally 26%. Do not send returns back C.O.D.

for you. When you place an order with Pierce Sales the terms and conditions of payment,

shipping, delivery, and claims form a part of the agreement between the purchaser and Pierce Sales.

The agreement is to be performed in Clay County, Texas. Pierce Sales is not responsible for and

has no liability for damage in shipment, during assembly, installation, erection, or that arising

from accidents, abuse or improper operation of the goods, equipment or merchandise.

GENERAL PRODUCT & WRECKER BED LIMITED WARRANTY:

Pierce Sales warrants to the original purchaser only (whether a wholesale, OEM, or retail customer)

that the goods, equipment, and merchandise manufactured by Pierce Sales are free from defects in

material and workmanship. Such limited warranty on winches and parts covers such items for a

period of twelve (12) months on mechanical and six (6) months on electrical from the date of shipment

by Pierce Sales. Pierce Sales reserves the right, at its option, to repair or replace the merchandise

proved to be defective only upon return to the Pierce Sales manufacturing facility in Henrietta, Texas, shipping prepaid.
Pierce Sales also warrants, to the original purchaser only, that our Wrecker Beds will be free from

defects in material and workmanship with coverage for a period of twenty-four (24) months from the

date of shipment by Pierce Sales. The first twelve (12) months to be covered at 100% on parts and

labor, and the second twelve (12) months to be pro-rated for the metal parts manufactured by Pierce

Sales only. These limited warranties will be valid only if ALL of the requirements listed in our warranty

are completed.
Merchandise proved defective within the applicable warranty period will be repaired or replaced, at

Pierce Sales’ option when that merchandise is returned prepaid to the Pierce Sales facility in

Henrietta, Texas. Pierce Sales must be notified promptly in writing, about the defect before any

means of repair have been made. The merchandise must be delivered by the purchaser to Pierce

Sales in Henrietta, Texas at the purchaser’s expense.
Merchandise sold by Pierce Sales, but not manufactured by it, is not warranted by Pierce Sales

and is subject to the manufacturer’s warranty only. The manufacturer’s warranty is available for

such goods upon request.
All warranties cover only the product or product parts, and are nontransferable. The warranty does

not bear the cost of transportation charges, claimed down time, loss of profit or goodwill, or any other special, incidental, indirect, or consequential damages, concerning or related to any product or part,

whether based upon negligence, strict liability, breech of contract, breech of warranty,

misrepresentation, or any other legal theory.
Pierce Sales makes no warranty, expressed, or implied as to finished products manufactured or

supplied by other manufacturers, and supplied from Pierce Sales to the purchaser, including but

not limited to, any vehicle to which our product is affixed to, and any accessories. Pierce Sales

expressly disclaims any implied or expressed warranties of merchantability or fitness for a

particular purpose as to such equipment or products.
Pierce Sales Warranty is not intended to cover normal maintenance parts, including but not limited

to, wear pads, bushings, mud flaps, fender flares, light bulbs, oil filters, and remote holders. Nor is

the warranty intended to cover any change, or defect due to accident, misuse, improper, or

unauthorized repair, failure to provide maintenance, or uses for which the equipment was not

intended, normal deterioration of trim, paint, or appearance, due to weather, or road conditions.
Pierce Sales winch and wrecker beds are not designed or intended for the movement of people

and are not to be used in the operation of elevators, or for such similar purposes and/or any

other improper uses.
